1. Introduction
Welcome to Peanich-Phum Co. Ltd. (“we,” “us,” “our”). These Terms and Conditions govern your use of our website located at https://peanich-phum.com/ and our logistics services, including but not limited to courier delivery, large-item delivery, freight forwarding, and related services (collectively, the “Services”) within Cambodia.
By accessing our website and using our Services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to all terms, you may not access the website or use our Services.
2. Definitions
- “Customer,” “you,” “your” refers to any individual or entity using our Services.
- “Consignment” refers to any item, package, parcel, or cargo entrusted to us for delivery.
- “Prohibited Items” refers to items we do not accept for transport, as detailed in Section 6.
3. Services Offered
We provide a range of logistics solutions in the Kingdom of Cambodia, including:
- Express courier delivery (small parcels and documents)
- Large-item and heavy goods delivery
- Freight forwarding and haulage
- Warehousing and storage (if applicable)
- Last-mile delivery
Service availability may vary depending on the pickup and delivery locations within Cambodia.
4. BookingandQuotations
- Quotes provided on our website or by our representatives are valid for a specified period and are based on the information provided by you at the time of inquiry.
- Final charges may be adjusted if the actual weight, dimensions, or delivery address differ from the original information provided.
- You are responsible for providing accurate and complete pickup/delivery addresses, contact information, and item descriptions.
5. PaymentTerms
- Payment terms will be as agreed upon at the time of booking (e.g., cash on delivery, bank transfer, credit card).
- For business clients, credit terms may be offered subject to a completed credit application and approval.
- We reserve the right to withhold services or hold consignments until all outstanding invoices are paid in full.
6. Prohibited Items
You agree not to submit for transport any Prohibited Items, including but not limited to:
- Illegal goods, narcotics, counterfeit products, and weapons.
- Perishable goods requiring refrigeration (unless a specific service is agreed upon).
- Flammable, explosive, or hazardous materials.
- High-value items such as cash, jewelry, precious stones, and negotiable instruments without prior written agreement and declared value.
- Live animals.
- Any item prohibited by the laws of Cambodia.
We reserve the right to inspect any consignment. Discovery of Prohibited Items may result in the cancellation of the shipment, forfeiture of fees, and reporting to the relevant Cambodian authorities.
7. PackagingandLabeling
- The customer is responsible for ensuring all items are packaged securely and appropriately to withstand the normal rigors of transport.
- Each consignment must be clearly labeled with the complete delivery address and contact information.
- We are not liable for damage resulting from inadequate or defective packaging.
8. Delivery
- We will make every reasonable effort to deliver within the estimated timeframe, but these are not guaranteed and are not considered a fundamental term of the contract.
- Delays may occur due to circumstances beyond our control (Force Majeure), including but not limited to: traffic conditions, weather, customs inspections, political unrest, or public holidays.
- If the recipient is not available, we will attempt to contact them to arrange a new delivery time or for the parcel to be collected from a designated point.
9. LiabilityandLimitations
- Our liability for loss, damage, or delay is strictly limited.
- For lost or damaged goods, our maximum liability shall be the direct loss up to the value of the transportation charges paid for that consignment or a predetermined amount per kilogram, whichever is lower, unless a higher value has been declared in writing and an additional insurance fee has been paid.
- We are not liable for any indirect, consequential, or incidental damages, including loss of profit, income, or business opportunity.
- Customers are advised to purchase additional insurance for high-value items.
10. Force Majeure
We shall not be held liable for any failure or delay in performing our Services due to events beyond our reasonable control, including acts of God, war, riot, civil commotion, government actions, strikes, lock-outs, traffic congestion, accidents, or severe weather conditions.
11. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Cambodia. Any disputes arising from these terms or our Services shall be subject to the exclusive jurisdiction of the courts of Cambodia.
12. Amendments
We reserve the right to modify these Terms and Conditions at any time. The updated version will be posted on our website with a revised “Last Updated” date. Your continued use of our Services after any changes constitutes acceptance of those changes.
